Arbitration FAQs

Arbitration is a procedure in which a dispute is submitted to one or more arbitrators who make a decision outside of court.

Arbitration is available to those who sign the BYU student housing contract, both landlord and BYU student. Before someone can go through arbitration at the CPCR, they must make a good faith effort to resolve their issues in mediation, as stated in paragraph 9 of the BYU Off-Campus Housing Agreement. Mediation gives you the opportunity to be proactive and create an agreement that you feel good about with someone you are in a conflict with. We find that meeting together, with the help of an impartial third party, can be very empowering. If, however, you do not reach an agreement in mediation, you can elect to turn the problem over to an arbitration board to decide the issue for you.
